I read the EMS license and it has this line:
"* You may use the software for non-commercial purposes including instructional use, research and/or design, development and testing of projects for class assignment and tests or personal projects. You may not use the Program software for any for-profit software development."
I am a developer an have been in Web Development for over a year now. I sell what I develop. I haven't used Windows for development, since you don't need Windows for Web Development (PHP/MySQL).
However, I am learning desktop programming and have learnt Java. But I found that Java programs are not too appealing. Also, they need huge JREs which need to be downloaded to run the program. I don't and wont use .NET for similar reasons(Windows XP is the most widely used OS, but it doesn't come with .NET,so the same problem persists with this one too) + .NET programs run only on Windows systems. I may get clients who want cross platform applications. So I have decided to use C++ + QT (same thing used for the very popular VLC media player 1.x). QT programs are cross platform and I will take care of platform independent coding in C++. However, I want to make binaries available for the users (instead of giving just the source and asking them to download and install development libraries in their systems) along with the source codes to the clients (I generally give away source codes of what I create with GPL license unless of course the client does not want the source).
So I wish to use ELMS Windows in a virtual machine so that I can install QT Creator and compile and test my application and give away the win32 and win64 binaries (when I sell the application). Can I do so? I mean is it legal to do so? Or will I be violating the ELMS while doing so? Also, am I allowed to do so if I wish to distribute the software free of cost (without charging any money)?
Please clarify. I need correct answers so make sure you know what you are saying. It is better if you represent Microsoft in one way or other.

Boy, did you find the answer? I have a question too. If I write scripts in php using apache, php/mysql in windows platform provided I have Windows XP Genuine (From ELMS), can I sell the product?
